　　上诉人上海市黄浦建筑设计院、上海万国企业发展公司因建筑工程设计费纠纷一案，不服上海市宝山区人民法院(1996)宝民初字第2141号民事判决，向本院提起上诉。本院依法组成合议庭审理了本案，现已审理终结。

　　原审法院认定，1994年7月2日，上海万国企业发展公司(以下简称万国公司)与上海祁连房地产开发总公司签订祁连山居住区(中块)合作开发协议。协议约定，由万国公司负责居住区中块总图和单体设计工作及费用。据此，万国公司将中块总图设计及中块A1、B2街坊部分住宅工程分别委托上海市黄浦建筑设计院(以下简称黄浦设计院)设计，中块总图双方已履行完毕。1994年10月，万国公司与黄浦设计院签订了A1、B2街坊部分住宅工程设计合同，房型为3种，建筑面积为7万平方米。合同约定，设计方案包括方案设计、施工图设计两个阶段；万国公司在1994年10月10日向黄浦设计院提供方案设计所需的设计资料后，黄浦设计院在7天内向万国公司提交方案设计供万国公司认可，万国公司在收到初步设计文件后应尽快报有关部门审批，及时将有关部门的正式批准文件送达黄浦设计院，黄浦设计院根据有关部门对初步设计的审批意见，作必要的修改和调整，双方在完成上述工作后，黄浦设计院在15天内向万国公司提交平、立、剖施工图，30天内提交全套施工图。设计费双方约定，单价为每平方米8.62元，单体重复利用需配基础或局部修改的，按0.3收设计费，完全可以套用的按0.2收设计费，设计费暂估为18万元(按建筑面积结算)，万国公司向黄浦设计院支付20%的定金3.6万元，初步设计文件完成时，再支付设计费50%，另外双方还约定黄浦设计院对其完成的设计文件作技术交底、施工配合、参加各阶段验收。合同签订后，万国公司按约支付了定金3.6万元。万国公司派驻现场的办事员刘伟龙在1994年10月21日向黄浦设计院提交单体设计要求，在黄浦设计院的一份建筑平面图上，刘伟龙于1994年11月3日签字，同意按此方案作施工图。黄浦设计院在未经有关部门审批的情况下，即进行施工图设计。黄浦设计院设计的施工图为6种房型，甲号5539平方米，套用四套；戊号4410平方米，套用四套；巳号3384平方米，套用一套；庚号4148平方米；辛号5431平方米，壬号3910平方米，套用三套，设计总面积81732平方米，设计费325871元。1994年11月15日，上海祁连房产开发总公司为报送规划部门申请规划许可证，由该公司人员沈海平从黄浦设计院提取了A1、B2街坊的全套施工图，该公司留下自己需要的份数后，沈海平于1994年12月3日及12月5日将施工图交给了万国公司的刘伟龙。1995年1月4日，黄浦设计院与万国公司签订补充合同，万国公司认可原合同的3种房型变更为6种，并按6种房型计算设计费，套用图纸暂按0.2计算，如果以后地基处理出图不同，万国公司再付0.1，其余条款按原合同执行。以后因万国公司内部情况发生变化，委托黄浦设计院设计的项目被撤销，对黄浦设计院设计的施工图已不再需要，双方为设计费支付发生纠纷并诉至法院。

    原审法院判决：万国公司应支付黄浦设计院工程设计费192109.70元(已扣除3.6万元定金)，于本判决生效后十日内履行完毕。

　　黄浦设计院不服原判上诉称，根据建设部规定，小型和技术要求简单的建筑工程，可以“方案设计”代替“初步设计”，故原审认定上诉人设计程序违法缺乏依据；设计院与万国公司的补充合同证明万国公司应支付设计费325871元，但原审法院未支持上诉人的诉请有失公正，请求撤销原判，判令万国公司支付设计费289871元，支付94年11月16日起至执行到止的逾期付款违约金。

　　万国公司不服原判上诉称，黄浦设计院在未收到有关部门正式审批意见时，擅自提前进行施工图设计，且方案设计代替初步设计，而又未达到规定的深度，违反国家有关规定；设计院在完成施工图设计后，未将图纸交付给万国公司，其应自己承担施工图设计的费用，故请求撤销原判，支持万国公司的诉讼请求。

　　本院审理查明，原审法院认定的事实无误，有合同、补充合同、设计委托协议、设计图纸、签收单、调查笔录、庭审记录、咨询报告等证据佐证。另查，建设部规定的“小型和技术要求简单的建设工程是指3000平方米以下的4、5级工程项目”。上述事实有建设部92年3月2日颁布的《建筑工程设计文件编制深度的规定》证实。

　　本院认为：上诉人黄浦设计院接受委托设计的工程项目建筑面积7至8万平方米，就每一建筑单体也在3400至5500平方米之间，因此，该项目显然不属小型工程，黄浦设计院认为该项目可以“方案设计”代替“初步设计”缺乏依据；鉴于合同约定的列入国家规定工程设计收费内容的设计修改、技术交底、施工配合等工作实际没有实施及设计过程中未严格按照设计规范程序办理，方案设计成品不完整，深度不够等事实，黄浦设计院应承担一定的经济责任。原审法院作出酌情减扣设计费的判决并无不当，黄浦设计院的上诉请求理由不足，本院不予支持。上诉人万国公司对黄浦设计院完成施工图后出具的整个工程的设计收款通知未持异议，在以后的“补充合同”中承认设计院提供了6种组合的立面完全不同的房型，并明确按6种房型计算设计费，至此表明万国公司对施工图的提交已事实确认；关于“方案设计”代替“初步设计”及提前进入施工图设计一节，并非黄浦设计院单方面行为，而是由双方约定，并由万国公司的联系人员直接授意下进行的，对此，万国公司应承担相应的经济责任。鉴于工程项目不再实施的责任不是黄浦设计院造成，故万国公司应承担支付工程设计费的民事责任。万国公司的上诉请求理由不成立，本院依法予以驳回。依照《中华人民共和国民事诉讼法》第一百五十三条第一款第(一)项之规定，判决如下：

驳回上诉，维持原判。


　　上诉案件受理费人民币7608.10元，由上海市黄浦建筑设计院、上海万国企业发展公司各半负担。
